Election Frequency & Terms

Eligibility

Type A City (Local Gov't Code, Section 22.032)

Mayor Residence -- 1 year in state prior to the filing deadline; 1 year in city prior to election day Age -- 18 - Must be a registered voter at the time of the election (not required at time of filing)

Council member Residence -- 1 year in state prior to filing deadline; 6 months in the city (or ward) prior to filing deadline (Texas Elec. Code, Section 141.001(a); Brown v. Patterson, 609 SW 2nd 287) Age -- 18 - Must be a registered voter at the time of the election (not required at time of filing)

In accordance with the standard eligibility requirements for a city office, a candidate must:

1. be a United States citizen;

2. not have been determined by a final judgment of a court exercising probate jurisiction to be: totally mentally incapacitated; or partially mentally incapacitated without the right to vote;

3. be a registered, qualified voter of the State of Texas;

4. not have been finally convicted of a felony from which the person has not been pardoned or otherwise released from the resulting disablities;

5. not be in arrears in tax payments or other liabilities to the City;

6. not be disqualified by any provision of any section of the City Code.

Any member of the Council that ceases to possess qualifications specified above or that is convicted of a felony before or while in office shall immediately forfeit that office. No Council person shall hold any other public office except for Notary Public, member of the National Guard or Military Reserves, or retired member of the Armed Services.
